By accessing or using Siteflo ("the Service," "the App," "Siteflo"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use Siteflo.

Siteflo is a construction management platform that uses artificial intelligence to analyze construction documents, track project progress, generate reports, and provide analytics for construction companies and professionals.

Key Features Include:

• AI-powered document analysis and classification
• Real-time project tracking and progress monitoring
• Automated report generation (schedules, bids, invoices, blueprints)
• Safety incident reporting and compliance tracking
• Time and cost analytics
• Team collaboration and communication tools

Account Registration

• You must provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account

Eligibility

• You must be at least 18 years old or the age of majority in your jurisdiction
• You must have the authority to enter into this agreement
• Business accounts must be registered by authorized representatives

Account Types

• Individual Accounts: For individual workers and professionals
• Company Accounts: For construction companies and organizations
• Enterprise Accounts: For large organizations with custom requirements

Subscription Plans

Siteflo offers various subscription tiers with different features and capabilities. All subscriptions are sold exclusively through direct sales contracts.

Payment

• All payments are processed through direct sales agreements
• Subscriptions are billed monthly according to your enterprise contract terms
• Prices and billing cycles are specified in your direct sales agreement

Refunds

Refunds are only available if you cancel within one week of a monthly purchase. No refunds are provided after the one-week cancellation period.

Permitted Uses

• Use Siteflo for legitimate construction management purposes
• Upload and analyze construction-related documents and data
• Collaborate with team members on construction projects
• Generate reports and analytics for business purposes

Prohibited Uses

You may not:

• Use Siteflo for any illegal or unauthorized purpose
• Upload malicious software, viruses, or harmful content
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools to access the Service without permission
• Share account credentials with unauthorized users
• Upload non-construction related content or spam
• Violate any applicable laws or regulations

Your Content

• You retain ownership of all content you upload to Siteflo
• You grant Siteflo a license to process, analyze, and store your content to provide the Service
• You are responsible for ensuring you have the right to upload all content

AI Processing

• Siteflo uses AI to analyze your uploaded content
• AI processing helps classify documents, extract data, and generate insights
• AI-generated outputs are provided as tools to assist your work

Data Security

• We implement industry-standard security measures to protect your data
• Your data is stored on secure cloud infrastructure
• We maintain backup and disaster recovery procedures with a 5-year data retention guarantee

Siteflo offers an optional SMS/MMS text-messaging service (and, where available, WhatsApp) that lets construction field crews send job-site photos, voice notes, and updates into their project and receive operational replies, reminders, and end-of-day summaries. By participating in a project text thread, you agree to these messaging terms.

Program Description

Messages are operational and work-related only — job-site updates, answers to questions, task reminders, and summaries. This is not a marketing program.

Opt-In and Opt-Out

• Field workers are added to a project text thread by their employer or project manager within Siteflo, and consent to receive messages by participating.
• Reply STOP at any time to unsubscribe; you will receive a confirmation and no further messages will be sent.
• Reply HELP for help and support contact information.

Frequency, Rates, and Carrier Disclaimer

• Message frequency varies based on job-site activity.
• Message and data rates may apply.
• Mobile carriers are not liable for delayed or undelivered messages.
• We may modify or discontinue the messaging program at any time.

The handling of mobile information is described in our Privacy Policy. We do not sell or share mobile phone numbers or SMS opt-in consent with third parties for their own marketing or promotional purposes.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Siteflo Property

• Siteflo owns all rights to the platform, including software, algorithms, and AI technology
• Our trademarks, logos, and brand elements are protected intellectual property
• You may not copy, modify, or distribute our proprietary technology

User Content

• You retain ownership of your uploaded content
• Siteflo does not claim ownership of your construction documents or data
• You grant us necessary rights to process and analyze your content

Service Availability

• We strive to provide reliable service but cannot guarantee 100% uptime
• Scheduled maintenance will be communicated in advance when possible
• We are not liable for service interruptions beyond our reasonable control

Service Modifications

• We may update, modify, or discontinue features with reasonable notice
• Major changes will be communicated through your account or email
• Continued use after changes constitutes acceptance of modifications

Disclaimer of Warranties

Siteflo is provided "as is" without warranties of any kind. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

Limitation of Damages

To the maximum extent permitted by law, Siteflo's liability is limited to the amount paid for the Service in the 12 months preceding the claim.

AI-Generated Content

• AI-generated reports and analytics are tools to assist your work
• You are responsible for reviewing and validating all AI outputs
• We are not liable for decisions made based on AI-generated content

You agree to indemnify and hold Siteflo harmless from claims arising from:

• Your use of the Service
• Your violation of these Terms
• Your uploaded content
• Your violation of applicable laws

Termination by You

• You may terminate your account according to your enterprise agreement terms
• Upon termination, you may export your past project data as specified in your contract

Termination by Siteflo

We may terminate accounts for:

• Violation of these Terms
• Non-payment according to contract terms
• Illegal or harmful activities
• At our discretion with reasonable notice

Effect of Termination

• Access to the Service will cease
• We retain your data indefinitely for business and legal purposes
• You may export your past project data upon request
• Certain provisions of these Terms survive termination

Governing Law

These Terms are governed by the laws of New Jersey, United States, without regard to conflict of law principles.

Dispute Resolution

• Disputes will be resolved through binding arbitration in New Jersey as specified in enterprise agreements
• Class action lawsuits are waived where permitted by law
• You may seek injunctive relief in appropriate courts in New Jersey

Entire Agreement

These Terms, along with your enterprise agreement and Privacy Policy, constitute the entire agreement between you and Siteflo.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.

No Waiver

Failure to enforce any provision does not constitute a waiver of that provision.

Assignment

You may not assign these Terms without our written consent. We may assign these Terms without restriction.
